Supplementary Protection Certificate (SPC) — extending a patent

An SPC extends the base patent by up to 5 years for medicinal and plant-protection products where pre-marketing administrative approval is required (Art. 75, Law on Industrial Property).

When it applies

How additional duration is calculated

Period equal to the time between the filing date of the base patent and the date of first marketing authorization, minus 5 years, up to a maximum of 5 years.

Form and procedure

File form P-6 within 6 months of the first marketing authorization.
