Form TM-1 and filing date

The application is filed on form TM-1. The filing date is set when IPPO receives the minimum elements: the request, applicant details, a graphical representation, and a list of goods/services.

Paris Convention priority can be claimed within 6 months of a first filing in a member country.

Nice Classification

Goods and services are grouped in classes 1–34 (goods) and 35–45 (services). Tip: don't "hunt" classes. Describe precisely what you do — a broader list means higher fees and more exposure to opposition.

Graphical representation of the sign

Accepted format: PNG at minimum 300 dpi, no shadows, no background. For color marks, designate the colors using Pantone or RGB references.

Office Action response

IPPO may request amendments or clarifications. The typical response deadline is 60 days, with possible extensions under the Rulebook.

Opposition response

If a third party files an opposition after publication, the applicant has 60 days to respond in writing with evidence (use, distinctiveness, lack of similarity).
